Development Description
A declaration is sought in respect of the following development: the construction of an agricultural shed (as referenced under File EXD01286), having regard to associated and ancillary site works observed on the lands, including; - Electricity connection and associated infrastructure - Drilling of a private well (approx. 160 ft) with submersible pump - Significant excavation, earth moving and ground levelling - Construction of hardcore/hardstanding areas - Creation of an additional site entrance - Significant development and altering of original site entrance - Construction of two internal access driveways - Installation of post-box, solar lights, and CCTV cameras These works are included so that the Planning Authority can consider the full scale and impact of development taking place on the site versus the stated intention for use. (Scale Map and photographs evidencing scale and impact attached) The lands are currently subject to an active enforcement file (Ref. 0168-2025) and have a planning history that includes several refusals for residential development. A declaration is sought as to whether the development is exempt under the Planning and Development Regulations 2001 (as amended), in particular Schedule 2, Part 3 (Agriculture), and Article 9. While a previous declaration (EXD01286) considered the agricultural shed on its own, it is requested that the Planning Authority assess the entire development now taking place on the lands, including all associated works, rather than the shed in isolation. The scale of the works, their cumulative impact, the planning history of the site, and the provisions of Article 9 all require consideration when determining whether the development is exempt.
